StoryTracks Terms of Service

Welcome to StoryTracks.

These Terms of Service govern your access to and use of the StoryTracks website, services, song creation tools, custom song products, and related content.

By using StoryTracks, submitting information, placing an order, or purchasing a song, you agree to these Terms.

If you do not agree, please do not use StoryTracks.

1. What StoryTracks Does

StoryTracks helps customers turn personal stories, family memories, team moments, business messages, community traditions, and special occasions into custom songs.

Our process may include:

• guided story intake;
• AI-assisted interview and story organization;
• lyric writing and editing;
• quality review;
• AI-assisted music generation;
• final song delivery;
• review and revision support, as described in the offer displayed at purchase and these Terms.

StoryTracks may use third-party artificial intelligence tools, music-generation platforms, audio tools, payment providers, hosting providers, and other service providers to create and deliver songs.

2. Eligibility

If you submit information about children, family members, friends, employees, teams, customers, churches, schools, businesses, organizations, or other people, you represent that you have the right or permission to provide that information and use it for the requested song.

3. Customer Content

“Customer Content” means anything you submit to StoryTracks, including but not limited to:

• names;
• stories;
• memories;
• photos or image references;
• business information;
• team or organization information;
• song preferences;
• style references;
• written answers;
• voice input;
• text messages;
• revision requests;
• any other information you provide.

You retain ownership of the Customer Content you submit.

By submitting Customer Content, you give StoryTracks permission to use, process, edit, summarize, transform, and provide it to third-party tools or service providers as reasonably necessary to create, review, revise, deliver, and support your custom song.

You are responsible for ensuring that your Customer Content does not violate another person’s rights, privacy, publicity rights, trademark rights, copyright rights, or other legal rights.

4. Prohibited Customer Content

You may not submit content that:

• infringes someone else’s copyright, trademark, privacy, publicity, or other rights;
• includes copyrighted lyrics, poems, scripts, or other protected material that you do not have permission to use;
• asks StoryTracks to copy a specific living artist, singer, celebrity, or public figure;
• asks StoryTracks to clone or imitate a real person’s voice;
• contains private, sensitive, or confidential information you do not have permission to share;
• is defamatory, harassing, abusive, hateful, sexually explicit, exploitative, or unlawful;
• promotes violence, self-harm, illegal activity, or fraud;
• is intended to deceive listeners into believing a real person, artist, organization, or business created or endorsed the song when they did not.

StoryTracks may refuse, cancel, revise, or remove any order or content that we believe violates these Terms or creates legal, ethical, or safety concerns.

5. AI-Assisted Creation

StoryTracks uses AI-assisted tools as part of the creative process.

You understand and agree that:

• AI-generated or AI-assisted outputs may vary in quality;
• similar prompts or stories may produce similar outputs;
• StoryTracks cannot guarantee that a song will be completely unique in every musical element;
• StoryTracks cannot guarantee that AI-generated content will be eligible for copyright registration;
• StoryTracks cannot guarantee exclusivity unless we separately agree to that in writing;
• third-party AI tools may have their own terms, restrictions, and limitations.

StoryTracks will make reasonable efforts to create songs using tools and account types intended to allow commercial use of delivered songs. However, your rights may still be subject to the terms, limitations, and policies of the third-party tools used in the creation process.

6. Ownership and Usage Rights to Delivered Songs

This section explains what rights you receive in your completed StoryTracks song.

6.1 Customer Input

You own the original stories, memories, names, business information, and other Customer Content you submit, subject to any rights held by other people.

6.2 StoryTracks Work Product

StoryTracks owns or controls its website, workflows, prompts, processes, internal drafts, quality-control notes, internal Suno or AI prompts, unpublished song versions, system outputs, templates, and other behind-the-scenes materials used to create your song.

Unless we separately agree otherwise, you do not receive ownership of StoryTracks’ internal tools, prompts, processes, drafts, or unpublished materials.

6.3 Final Delivered Song

After full payment and final delivery, StoryTracks grants you a broad, worldwide, royalty-free license to use the final delivered song for lawful personal, family, business, promotional, social media, event, fundraising, team, community, and commercial purposes, subject to these Terms and any applicable third-party provider terms.

This license includes the right to:

• download and save the song;
• play the song privately or publicly;
• share the song with friends, family, customers, teams, or community members;
• post the song on social media;
• use the song in slideshows, videos, websites, advertisements, events, fundraisers, team celebrations, business promotions, or similar uses;
• monetize the song where allowed by applicable law and provider terms.

To the extent StoryTracks owns or controls any assignable rights in the final delivered song, StoryTracks assigns those rights to you upon full payment, except for the rights StoryTracks expressly retains in these Terms.

6.4 Limits on Ownership

Because songs may be created or assisted by artificial intelligence tools, StoryTracks does not guarantee that:

• the final delivered song is eligible for copyright protection;
• you will be able to register copyright in the song;
• the song is exclusive to you;
• no similar song, melody, lyric, vocal sound, or musical element will ever be generated for someone else;
• the song can be distributed on every platform without review, rejection, or additional requirements;
• the song will never be subject to a claim, takedown, dispute, or platform restriction.

Your rights are also subject to the terms and limitations of the third-party music-generation or AI tools used to create the song.

6.5 No Famous Artist, Song, or Voice Imitation Rights

Your purchase does not give you the right to claim that a song was created, sung, endorsed, performed, or approved by any famous artist, celebrity, public figure, band, company, school, church, team, or organization unless you have separate written permission from that person or entity.

You may not use a StoryTracks song in a way that falsely suggests endorsement, sponsorship, or affiliation.

7. StoryTracks Portfolio and Marketing Use

StoryTracks will not publicly post or use your final delivered song, name, family details, photos, business information, or story as a public example without your permission.

If you give permission, you grant StoryTracks the right to use the approved song, testimonial, business name, first name, category, or related materials for portfolio, marketing, website, social media, or advertising purposes.

You may withdraw future marketing permission by contacting StoryTracks. Withdrawal will not require StoryTracks to remove materials already printed, published, distributed, or used in paid campaigns before we process your request, but we will make reasonable efforts to stop future use.

8. Payment

Payment is required before final delivery unless otherwise stated.

Prices, packages, included features, delivery timelines, and revision limits may change at any time.

Payments may be processed by third-party payment providers. StoryTracks does not store full credit card numbers.

You agree to provide accurate payment and billing information.

9. Revisions

StoryTracks wants the delivered song to accurately reflect the customer’s original story and approved creative direction.

If you believe the delivered song contains a meaningful problem with the story interpretation, lyrics, pronunciation, audio quality, musical result, or another important aspect of the finished song, please contact support@getstorytracks.com and explain the concern in reasonable detail.

Unless a different period is displayed at purchase, revision requests must be submitted within 7 calendar days after delivery.

StoryTracks will personally review each revision request and determine the appropriate response. Depending on the circumstances, this may include correcting lyrics, revising story details, adjusting the creative direction, producing a revised version of the song, providing another reasonable remedy, or explaining why the request falls outside the original order.

Revision support is intended to correct meaningful problems with the delivered song based on the customer’s original submitted story and approved direction. It does not include unlimited revisions, repeated preference changes, entirely new song concepts, new recipients, new occasions, substantially different stories, or a completely different musical direction.

Requests that materially change the original story, recipient, purpose, genre, style, or approved direction may require an additional purchase.

StoryTracks may refuse revision requests that are unlawful, abusive, technically impractical, outside the original order, submitted after the applicable review period, or inconsistent with these Terms.

10. Refunds

Because StoryTracks creates custom digital products based on your submitted story, all sales are generally final once work has begun.

StoryTracks may, in its discretion, offer a revision, credit, partial refund, or full refund if we are unable to deliver the purchased service or if there is a material problem with the order.

Refunds are not guaranteed for:

• change of mind;
• dissatisfaction caused by unclear or incomplete customer input;
• requests outside the original approved direction;
• limitations of AI-generated music;
• platform restrictions outside StoryTracks’ control;
• customer failure to review or respond to requests for information.

If you believe there is a problem with your order, contact support@getstorytracks.com within 7 calendar days after delivery and describe the concern in reasonable detail.

11. Delivery

StoryTracks will make reasonable efforts to deliver songs within the estimated timeline shown at purchase.

Delivery times are estimates only and may vary due to order volume, technical issues, third-party provider delays, revision requests, payment issues, incomplete information, or other circumstances.

StoryTracks is not responsible for delays caused by inaccurate customer information, late responses, third-party outages, or events outside our reasonable control.

12. Customer Responsibilities

You agree to:

• provide accurate information;
• review story summaries, blueprints, drafts, or confirmations when requested;
• only submit content you have the right to use;
• use delivered songs lawfully;
• comply with platform rules when posting or distributing songs;
• avoid false claims of endorsement or affiliation;
• avoid using StoryTracks songs in illegal, harmful, misleading, or infringing ways.

13. Third-Party Services

StoryTracks may rely on third-party services for hosting, AI processing, music generation, payment processing, analytics, email, file storage, and other functions.

StoryTracks is not responsible for third-party services, outages, pricing changes, platform decisions, account restrictions, distribution denials, takedowns, or terms changes.

Your use of a delivered song may be subject to third-party provider terms.

14. No Guarantee of Results

StoryTracks works to create meaningful, personalized songs. However, we do not guarantee:

• a specific emotional reaction;
• a particular musical style result;
• that a song will sound like a specific artist;
• that the song will be accepted by any streaming, advertising, social media, or distribution platform;
• that the song will generate revenue, donations, sales, engagement, or popularity;
• that all listeners will like the song.

Custom songs are subjective creative works.

15. Intellectual Property of the Website and Brand

The StoryTracks name, logo, website, design, prompts, workflows, text, graphics, software, processes, and related materials are owned by StoryTracks or its licensors.

You may not copy, reproduce, sell, reverse engineer, scrape, or misuse StoryTracks’ website, tools, prompts, systems, or brand materials without written permission.

16. Privacy

Your use of StoryTracks is also governed by our Privacy Policy.

By using StoryTracks, you consent to our collection and use of information as described in the Privacy Policy.

17. Limitation of Liability

To the maximum extent allowed by law, StoryTracks will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, reputational harm, emotional distress, or business interruption.

To the maximum extent allowed by law, StoryTracks’ total liability for any claim related to your order or use of the service will not exceed the amount you paid to StoryTracks for the specific order giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless StoryTracks from any claims, damages, liabilities, losses, costs, or expenses arising from:

• your Customer Content;
• your use of a delivered song;
• your violation of these Terms;
• your violation of another person’s rights;
• your unlawful, misleading, or unauthorized use of the service or final song.

19. Changes to These Terms

StoryTracks may update these Terms from time to time.

The updated version will be posted on the website with a new “Last updated” date.

Your continued use of StoryTracks after changes are posted means you accept the updated Terms.
